1 Policy:
The policy governing the use of this website and purchase and/or hire-purchase, lease of goods is mentioned hereunder. These terms and conditions apply to all orders received by Software Shop Limited online or offline

2 Management:

This website is jointly managed, owned and operated by Business Rentals Limited and Software Shop Limited
3 Consumer Protection:

With regard to consumer protection, all purchases made by individuals and for personal use are covered by the Consumer Guarantees Act 1993 applicable in New Zealand. Purchases made by businesses or for the purpose of commercial use are covered by the Sale of Goods Act 1908 applicable in New Zealand and not by the Consumer Guarantee's Act 1993

4 Privacy:

The Standard Policy of the Commonwealth Government of New Zealand and prevailing laws will be followed in all matters related to privacy. Customer details will never be disclosed to any third party unless enforced by law
5 Trade NOT Supplied:

Many of the products that we sell are promotional products, sold at low-margin, at cost or even below cost price. Such products are available for purchase by New Zealanders not engaged in similar trade as ourselves.
In order to be able to continue to offer many of our products at promotional prices to common New Zealanders, we do not want competing retailers to buy low margin items or promotional items from us for in-house use or for onselling. We believe that common New Zealanders should benefit from our prices and not a competing retailer.
In general Items for sale on our website are intended for end user customer(s) only. These items are not available for purchases by individuals or organisations engaged in similar trade.
If you are a competing retailer or connected or related to one or you are engaged in similar trade, please do not shop with us. In other words, if you are a competing retailer or connected or related to one or you are engaged in similar trade please do not buy place your order in our system. Any such attempt would be considered an abuse of our terms and in such an event Digital Shop reserves the right to take action or actions as deemed fit and proper at its sole discretion.
We reserve the right not to accept or ship any order which we believe is from someone who is connected with any competing retailer or is engaged in similar trade.
Please note that purchases for trading purposes will be allowed if and only if you are an approved business partner and have a prior business partnership agreement with us (in writing) or the item you are purchasing has been pre approved in writing by us for purchase by a retailer.
6 Warranty & Repair under Warranty:

Goods displayed on this website and sold by Digital Shop are well known international brands - products manufactured by multinational corporations and distributed in New Zealand by bonafide & accredited distributors and in almost all cases the goods are covered by the manufacturer's warranty. Please contact the manufacturer if you have any questions or doubts. Digital Shop will honour all warranties provided by the respective product manufacturers as applicable in New Zealand. The first step to claim relief under warranty is to lodge a complaint. Once the fault has been identified- the manufacturer will either repair or replace the item within a reasonable period of time. The decision to repair or replace will in all cases be decided at the sole discretion of the manufacturer or its agents. In the event a product cannot be repaired and the model has been made obsolete or superceded by another model, the manufacturer or distributor reserves the right to replace the faulty product with another model of similar functionality. The manufacturer's and/or the distributor's terms & conditions of warranty will apply in all cases. Customers have the option to contact the manufacturer directly or us (Digital Shop) for warranty issues. Please do not return any goods without an RA (Return Authorisation) number issued by us. Returned products without an RA number is not acceptable.
7 Payment & Payment methods:

Unless otherwise agreed in writing you will need to pay us within 24 hours of placing any order with us. Failure to do so may result in cancellation of the order at our sole discretion. Payment may be made by Cheque, Credit Card, Cash or Telegraphic Transfer. Orders will be processed only after receiving the buyer's cheque or proof of payment by Credit Card or Telegraphic transfer into the bank account of Software Shop Limited. PRODUCT PRICES: Cash and Credit Card prices for products are shown in seperate columns in the product pages. Cash price applies to: Cheques, Internet Banking Payment & Cash. Cash price shown includes a 2% cash discount. There is no cash discount available for credit card payments. So if you are buying with your credit card you will be paying more for the same item. We are able to provide cash discount for cash purchases as we do not have to pay credit card transaction fees to our banks. There are no such fees for cash, cheque or internet banking payments. Prices are subject to change without notice. The price listed at the time of placement of order will apply in all cases provided the price shown was not an error. So if the price drops after you have placed your order we will not be in a position to offer you the new price. Similarly, you dont have to pay more if the price increases after you have placed an order. To get your product at the listed price please place your order. Please remember that you will need to pay us within 24 hours of placing any order with us and your order will be processed only after your funds are cleared into our account. Orders are accepted subject to our terms and conditions, availability of stock etc. Payment by Internet Banking: Payment by Internet Bank Transfer is the easiest, quickest and cheapest method of payment. It is the most secured method of payment available as payments are transferred from one bank account to another within New Zealand. It is by far the most secure method of payment when you shop online and buy from a New Zealand based business How To: Log on to your Bank Website. All Banks in New Zealand provide Internet Banking facility. Set Software Shop Limited as a Bill Payee. Type in the exact amount to be paid and a small note as to what the payment is for. For example if the payment is for Macromedia Dreamweaver Software type : MACROMEDIA DREAMWEAVER MX (WINDOWS). Click Submit and Confirm. Thats all! Once Software Shop Ltd is set up as a bill payee in your account, the next time you buy any item from us the process is even easier. Just select us from the drop down list and type in the amount. It works like breeze.
8 Placing Online Orders:

Place your order online through this website. Please tick the appropriate payment mode. Currently we accept three forms of payment: (1) Cheque (2) Cash (3) Telegraphic transfer (4) Credit Card. If you choose to pay by cheque, please provide your cheque number along with other details as mentioned on the online Order Form and post us your cheque. If you choose to pay by telegraphic transfer please send us a copy of the bank receipt by fax or email. Remember, you cannot submit the order form unless all the required fields are filled in. Please note that the quickest way to transfer funds is pay into our bank account using internet banking facilities. Please provide a valid New Zealand landline number for all orders. 9 Phone Orders:

To place an order over the phone call us at (09)5773010 with the following order details: (1) Product no. (2) Model no. (3) Quantity (4) Name, delivery address and contact phone no.(5) Payment mode. If you choose to pay by cheque, please provide your cheque number and post your cheque to us. Your order will be implemented once we receive your cheque or proof of telegraphic transfer or payment by internet banking. GST is charged on New Zealand sales only at the rate of 12.5%. Please provide a New Zealand landline number for all orders.
10 Delivery Time:

Goods in stock: It is our endeavour to dispatch goods within 24 hours of receipt of payment for an order (if stocks are available). Please note that all delivery times are estimates and not guaranteed due to factors beyond our control. Please provide a valid New Zealand landline number for all orders. Goods not in Stock: If we are unable to supply any item due to shortage of stock or reasons beyond our control, we promise to keep you updated about the status of your order. Please note that goods not in stock at the time of placement of order will be supplied when they are available. We cannot guarantee any supply date for items not in stock as it is not in our control. Customers have the option to cancel any order without penalty before an item is shipped. Prices: Prices are valid while stocks last. Part Orders: Often customers place orders for more than one item. In cases where the order includes multiple items and one part of the order is fulfilled, customers have the option to cancel that part of the order which has not been fulfilled due to shortage of supply. Please note that items supplied as part of an order cannot be returned once the packaging is opened or the product used. Standard manufacturer's warranty will apply if the product is faulty. Back Orders: Customers can place back-orders for items not currently in stock with the supplier. Please note that occassionally a supplier may refuse to accept back orders if the product is being superceded by a new model. Customers have the option to cancel their order for items not in stock provided that such item(s) are not being imported specifically for that particular customer. Special items not normally imported, available or sold in NZ fall under this category.
11 Delivery & Shipping Costs:

Shipping is Free for orders over NZ$500 (cash price) (provided the item is not a bulk freight item). In all other cases where the total value of an order is below NZ$500 (cash price) a $10 DELIVERY SURCHARGE will apply on top of the item value for delivery anywhere in New Zealand. ZERO DELIVERY COST: There is no shipping cost involved if you pick up the item from the respective distributor's warehouse in New Zealand regardless the value of the order and whether or not the item is bulk freight item.. Bulk Freight Items: In general, items more than 25 KG by weight or 0.054 Cubic Metres by volume (outside packaging) or items which are very long are bulk freight items. Normal couriers refuse to ship such items and therefore have to be shipped by special bulk freight couriers. Some examples of bulk freight products: large monitors and televisions, large printers, projector screens, wide paper rolls etc. Shipping costs for bulk freight items are provided on case by case basis depending on the size and weight of the item, rates of the carrier and its destination. Please note that a customer will be made aware of the shipping costs involved in all cases before an order is processed where bulk freight charges are involved. Items will be shipped on bulk freight couriers if and only if the customer accepts and agrees to the costs. In other words there will be no nasty surprises. SUPPLIER WAREHOUSES

. 12 Return Policy for Damaged Goods/Opened Packages:

Goods found damaged/opened on arrival must be REFUSED. Please do not accept the package or open the original packaging.
13 (a) Return Policy for Shipment of Wrong Product:

Please check that you have received the correct product before opening the product packaging. If you have been shipped the wrong product we will accept the return at our cost as long as you have not opened the original product packaging. Please read the model number and/or product description before opening the package. If you have opened the product packaging we cannot accept return unless it is faulty.
14 Return of Goods Ordered:

Yes, we do accept return of goods should you wish to cancel your order after the goods have been delivered to you. However, please note that strict conditions apply. 1. Goods must be returned within 7 days to us. (2) The packaging MUST NOT be opened. If you open the packaging, the goods cannot be returned. (3) Cost for transportation will be subtracted from amount payable to you. (4) Certain products cannot be returned eg licenced software (5) In all cases, the policies of the distributor or manufacurer will apply (6) Handling cost amounting to 20% of the cost of the goods will be deducted. Please do not return any goods without an RA (Return Authorisation) number issued by us. Returned products without an RA number is not acceptable. Please note that we are not a "try before you buy" shop. In other words: please choose carefully. Please ensure that the product you have selected is the right one for the purpose for which you are purchasing it and is compatible with your existing system before you purchase from us. It is strongly recommended that you contact the manufacturer of the product to ascertain that the product will perform the job you require it for and is compatible with your existing system and infrastructure. In all cases customers are responsible for checking the compatibility of product(s) ordered. Please check the products and compatibility carefully before ordering and/or opening the product packaging.

15 (a) Errors & Ommissons: Errors and Omissions are to be expected.

Images: Many of the images on our website are generic in nature. Please consult the manufaturer's website for correct image and product specification. At all times it is the responsibility of the customer to consult the manufacturer or manufacturer website for product information. Please confirm with the manufacturer prior to purchasing from us.


15 (b) Limited Liability:

At any point of time the maximum liability of Software Shop Limited towards a buyer will be the value of the goods ordered. No claims of loss or damage exceeding the original purchase value of merchandise will be entertained.
16 Orders & Pick Up :

You are welcome to pickup your item from our office. Please note here that we DO NOT hold any stocks. Item ordered are brought in from our distributors once you place an order and wish to pick up the item personally from our office. Otherwise the items are shipped directly from the distributor's warehouse to you. In general if the item is in stock you can expect to receive the item within 24 hours (If the couriers dont bungle up) . Same day delivery is also possible. Please call (09)5702961 to check if same day delivery is possible. Please also note that advance payment is not required in case of pick ups. You may pay on delivery. Please provide a valid New Zealand landline number for all orders.
17 Listed Prices:

Prices listed on this website are "an invitation to treat only " and are subject to change without notice. We add a small markup on the prices offered by our distributors. A change in distributor's pricing for any item will mean a change in our prices too. Prices can also change depending on a competitor's price for a particular item. If the ordered item is not in stock with the supplier, we will ship the item as soon as the supplier brings in new stocks. Due to the nature of the trade we cannot guarantee any fixed date of shipping as we are dependant on our suppliers for stocks and supply. Please note we do not offer a "Cash On Delivery" service where you can pay to the couriers. Cash on delivery is possible only if you pick up your items from our office in Auckland. In other cases please pay in advance by internet banking, cheque, credit card. We provide 2% Discount if you pay by Cash/Cheque/Internet Banking. The cash price shown on our website reflects the discounted price.

18 Stock & Supply:

Items on sale on this website are sourced from a number of distributors who may or may not have stock of any particular item at a given point of time. Goods ordered will be supplied provided that it is in stock with the distributor.
19 Product Information Limited Liability:

We cannot and do not guarantee the accuracy of any product information or technical specifications provided on this website or over the phone. Customers are at all times responsible for selecting the product(s) they require and are strongly advised to consult with the manufacturer regarding technical specifications and product information before purchasing from us.
20 Jurisdiction:

Disputes, if any, will have to be resolved in the Courts situated in Auckland only.
21 LIMITATION OF OFFER:

Digital Shop reserves the right to not sell to individuals or organisations engaged in similar trade or if the purchase is being made for onselling. Purchases for trading purposes is allowed only if you are an approved business partner or where the purchase does not consitute abuse of our terms.
Digital Shop (Software Shop Ltd) at its sole discretion, reserves the right to refuse to accept or limit the quantity of items in orders from organisations/individuals which Software Shop Ltd believes is being purchased for trading purposes. Digital Shop / Software Shop Ltd reserves the right to limit the supply of products to one item only per customer for all orders if the items are clearance or promotional items, low stock items or priced very low. In all cases the quantity to be supplied will be determined by Software Shop Ltd at its sole discretion. Items listed for sale are subject to the availability of stocks and will last till stocks are available with our supplier.
